03 Local Rules

Middlesex Borough Regulates From 4 Inches, and Licenses the Contractor Too

Middlesex Borough sets one of the lower thresholds around here. Under Chapter 395 you need a tree removal project permit for any tree of 4 inches DBH or more, measured 54 inches above the ground, and the fee is $100. Where a removal goes with a new principal structure, no building permit issues until the tree permit is granted.

Two things to watch. Article II has no exemptions section at all — the code says trees may be removed “unless specifically exempted herein,” but no exemption list follows, so even dead and hazard trees are best treated as needing the permit, which the code allows on the grounds that a tree is dead, diseased or unsafe. And the Borough separately licenses landscaping and tree companies under Chapter 254, which is a requirement on your contractor rather than on you.

  • Permit required from 4 inches DBH, measured 54 inches up
  • Fee: $100 for a tree removal project permit
  • Article II contains no exemptions list — treat dead and hazard trees as needing a permit
  • Replacement runs from 4 trees up to 15, or $400 to $900 per tree into the Tree Fund
