Section 2-28.3 of the Borough Code limits the ordinance's reach over private trees to one short subsection, and that subsection sets no application requirement.
What does need a permit is any work on a street tree or a tree in the right-of-way — that goes through the Construction Office. Tree removal is also reviewed when it forms part of a subdivision or site plan, where trees are inventoried from 4 inches DBH and replacement is scaled to size. Private trees posing an emergency to people, property or utilities can be removed at any time.
